Highway Accident This Morning

So guys.... guess who was just in an accident this morning on the highway? I was.

I wasn't driving, I was a passenger, but here's the play-by-play of the accident:

Some Ahole lady in front of us stopped short in our lane (far right lane) trying to make a last minute move for the highway exit..... causing my buddy who was driving to jerk the wheel to avoid her.... causing us to slide sideways on the highway going 75mph across 4 lanes of traffic until we clipped the rear end of a pontiac grand prix gtp that had been in the far left lane. Our collision was directly on her rear passenger wheel, causing the wheel to buckle in on her car and seat itself directly under the passenger rear arm and send her going 180 degrees with sparks flying everywhere. She slid down the emergency lane for about 200 feet or so, all the while the car was facing towards the oncoming traffic, but luckily nobody else hit her....

Our car on the other hand.... after we had slid and tagged the rear end of that lady in the grand prix, we slid off the highway and into the grassy ditch between the highways.... our car spun around 3 times and landed perfectly in the middle of the grassy muddy ditch facing in the right direction. Amazing thing was, even after sliding across the 4 lanes of traffic, we only managed to tag the one person and didn't get hit ourselves.

I got pictures of the entire accident, the skid marks, the car damage, and even my buddy having to explain what happened to the cops...

lol failure to control? if a cop gave me that he would have to give me 2 tickets...1 for failure to control my car and 1 for failure to control my actions after he gave me the first ticket lol.

yeah this happened to me as well, when i totaled my first Tib the cop game me a "failure to control" ticket. I was like WTF no one got hurt, no one had any property dmg but my own, and I didnt hit anyone. that was a good 165 bucks wasted

Yea..... it was pretty stupid...... luckily we made it away with only a dented front bumper and a little offroad sliding in the G35..... The Pontiac rim and axle was screwed.

Sounds like your buddy was following too close and had an "Oh sh!t" reaction.

I agree he probably was too close.... but he was trying to move on up and pass someone when the lady decided to cut him off instead and hit her brakes while doing it.

Did you miss the entire bolded section above.... as I see you left a lot out in your quote? Its not that he was an Ahole...... the DumbAs$ lady decided to cut him off first and slam on her brakes. It was either swerve, or slam into her.

Doesn't matter. It was your friends fault. Okay, she stopped short, but he shouldn't have been that close to her. He lost control.

So you are saying that if I stopped short.....for whatever reason......it is my fault?? Doesn't work that way.

honestly, i wouldve slammed into the lady. that probably sounds alot safer than sliding across the damn highway and clipping into a pontiac and spinning out so damn far out into a ditch. i still cant fathom how you guys only came out with minor damage, thats just insane.

did you happen to remember the plates of the lady that cut you off? you couldve had the police track that lady down and involve her in it, being that she was the primary factor in you guys swerving out to begin with.

also, it sucks to hear about the BS ticket that the cops gave your friend. i guess they figured that if you could afford an infinity, you can afford the ticket. funny how that kind of shlt works, eh?

^^^^ Correct . My buddy wasn't all over her rear bumper to begin with, he was coming up the right hand lane when she pulled in front of him and cut him off and hit her brakes as she was trying to make it to her exit, and in doing so he swerved left to avoid her rear bumper, and the rear end of his car broke traction causing it to slide across the highway.

This would be very hard to prove in court unfortunately without the lady's identification. I was cut off on snowy roads by someone and hit my brakes and slid into him, and had a hell of a time getting insurance money from his company. (lawyer and 4 months time)

Yea... but at least I don't have to deal with it..... Sounds mean to say, but glad the scenario wasn't involving me for once....

There is no defense for this clown and he does not deserve a license to drive. By your own admission he was passing a car on the right, putting him in the slow lane at 75mph. Pass on the left, remember? His driving was worse than reckless, it was an accident waiting to happen.

you have no clue what his intentions were. maybe he was passing on the right because his exit was coming up and he was going to slow down.

Young kid, nice car, driving fast, passing on the right did not die today. Say thanks, pay ticket and learn to drive defensively. You might not be so lucky next time.
I don't think it's as simple as that.

I'm assuming the cop didn't witness this and came on the scene after it happened. If so, your friend can dispute that ticket pretty easily. It would be the police officer's job to gather the witnesses (ie. the person in the Pontiac assuming no one else stuck around other than you guys).

K scratch that, now that I think about it, your friend doesnt have much of a case without the woman who cut you off. Cause then technically he could say ANYTHING to justify his swerve (not saying its not justified) and get out of the ticket.. not that easy. So it makes sense that the cop gave your friend the ticket. He saw damage done to a Pontiac due to an out of control G35. It's a policeman's job to go by the book when handing out tickets to accidents they did not witness. It happened to me. I would still try to dispute it though. If the police doesn't have time to gather the witness/evidence (or just doesn't care enough), your friend is in the clear!

Yes, I do have a clue, he stated it in the post you must have missed...this is what he posted:

At 75+, in the slow lane, which is where most people pull into and slow down for their exit. And just what is the speed limit on that stretch of road? Probably not 75.
I'm glad everybody walked away from this one, and hope lessons were learned.

Urg..... To follow up on a few statements...... The stretch of road is a 65mph zone... he was flowing with traffic at 70.... had gone to 75 to pass the car on his left. (Agreed, not supposed to pass in the right lane... but it was open).... but as he was coming up the lady shot right in front of him and hit her brakes hard. And yes I can tell she was aiming for the exit because there was no other reason for her to have cut in front of him like that.

I agree he doesn't have a leg to stand on when it comes to the ticket because the lady that originally caused him to swerve didn't stick around.

All in all, I agree in defensive driving..... and yes, in this scenario he should have just slammed into the rear of her car.... but he was trying to avoid her bumper and I'm sure he wasn't thinking the rear end of his car was going to come around as he tried to avoid her. We are all lucky nobody got hurt in the accident and that he just did minor damage to the G35. Lesson learned... nuff said.

Now where's my bed.. I'm tired.
